Pet Friendly Rental Rules Are on the Way!

There’s an exciting change on the horizon for both tenants and landlords – and it’s all about our favourite furry family members. New laws around pets in rental properties are expected to take effect later this year, making it easier for tenants to have pets while still protecting landlords and their investments.
From December 1st, new tenancy rules for owning pets in rental properties will come into effect, and Tommy’s is here to make sure you’re ready.
So, What’s Changing?
Once the new laws come into effect, tenants will be able to apply for permission to keep a pet – and landlords will need a good reason to say no. It’s a big shift designed to make renting more flexible and family-friendly, especially for tenants who consider pets part of the whānau.
Here’s what you can expect when the new rules kick in:
Tenants will need written consent to have a pet.
Unless the tenancy agreement already allows pets, tenants must request permission in writing.
Landlords must say yes unless there are reasonable grounds to decline.
This could include things like property suitability (e.g no fenced section) or local council restrictions.
Landlords must respond within 21 days.
No more long waits – communication must be clear and efficient.
Pet bonds become available.
Landlords will be able to request a pet bond of up to two weeks rent, on top of the standard bond. This will be held by MBIE just like regular rental bonds.
Landlords can set fair conditions.
This could mean carpet cleaning at the end of the tenancy or restrictions on indoor areas.
Protections for both sides.
– If a landlord says no without good reason – or doesn’t reply within 21 days – they may face fines.
- Tenants who keep a pet without consent may also be fined.
- Tenants remain responsible for any pet-related damage beyond fair wear & tear.
Importantly: pets already living in a rental before the law change aren’t affected, provided they were allowed under the current tenancy agreement.
